Terms of Sale

These Terms of Sale apply to the ordering and supply of holiday accommodation services (the “Services”) offered from time to time on the Holiday Sleep LTD website (the “Website”) at https://holidaysleep.co.uk by Holiday Sleep LTD (“us” or the “Company”).
1. Parties
These Terms of Sale apply to the contractual relationship between you, the customer, and Holiday Sleep LTD (“us” or “we”), a company registered in England and Wales with company number [Your Company Number], of 64 Liberty Lane, West Bromwich, England, B70 0FL, trading as “Holiday Sleep LTD”.
Use of the Holiday Sleep LTD website itself is subject to our Terms of Use and Privacy Policy (together with these Terms of Sale, the “Terms”). Please read these Terms carefully. By booking a service from Holiday Sleep LTD, you agree to these Terms of Sale without limitation or qualification. If you do not agree to these Terms of Sale, then you must not book any Service from the Holiday Sleep LTD Website.
2. Services
We have taken reasonable steps to depict the Services accurately on our Website, but there may be minor differences from the descriptions on the Website due to variations in the presentation or due to differences in the way they are displayed on the screen of your device.

3. Booking
You must be at least 18 years old to book Services from us.
You can book Holiday Sleep LTD Services by visiting the Website and following prompts on-screen.
If you elect to create an account when booking from the Website, you warrant that all the information you provide is complete, accurate, and current. You are responsible for safeguarding your account details and subsequently for any activity that occurs under your credentials.
By confirming your booking at checkout, you are agreeing to these Terms of Sale and are under obligation to pay for the Service(s).
By clicking the “Confirm + Pay” button on the checkout page, you enter into an obligation to pay for the Service(s) you have selected. If your payment is accepted by our third-party payment processor, you will receive an email from us acknowledging that we have received your booking and payment has been authorised by your card provider. This does not mean that your booking has been accepted. Your booking constitutes an offer to us to buy a service and remains subject to acceptance by us. We are not obliged to accept your booking and may, at our discretion, decline to accept any booking. Where we accept your booking, we will confirm this by contacting you to arrange the details of your Service(s) and sending you an email once the booking has been confirmed. This email will initiate a contractual relationship between you, the customer, and us under these Terms of Sale.
We must receive full payment for the services before we can accept your booking.
All bookings are subject to acceptance and availability. If at the time you place your booking we are unable to fulfil it due to insufficient availability, we will notify you promptly at which point you can decide if you prefer to wait for the availability or cancel your booking. We reserve the right to cancel or reject any booking due to the unavailability of services.
We are not responsible for any mistakes made by you when placing your booking. It is your responsibility to ensure the details of your booking are correct. If you discover an error and your service has not yet been delivered, please contact
us immediately and we will make every effort to amend your booking.
4. Cancellation and Changes
4.1. Cancellation by You
If you need to cancel your booking, you must do so before the date of the service. Please contact us directly at admin@holidaysleep.co.uk.
If the service has already commenced when you contact us to cancel, you may not be eligible for a refund. Please refer to our cancellation policy provided on the Website for detailed information on cancellation fees and refund eligibility.
4.2. Changes by You
If you wish to make changes to your booking after it has been confirmed, please contact us as soon as possible. We will make every effort to accommodate your request, but we cannot guarantee that changes can be made. Additional charges may apply for any changes.
4.3. Cancellation by Us
We reserve the right to cancel your booking at any time. In such cases, you will receive a full refund. However, we will not be liable for any additional compensation or expenses you may incur as a result of our cancellation.
5. Prices and Payment
5.1. Prices
Service prices are displayed on our Website. The price includes applicable UK taxes and any specified services as outlined in the booking details.
We also offer additional services such as early check-in or late check-out, which can be selected during the booking process and will incur additional charges.
All prices on the Website are subject to change. Any changes to pricing will not affect any orders which have already been confirmed.
5.2. Payment
We accept payment by Visa, MasterCard, and American Express. When you place an order, you agree that all the payment information you provide is true and accurate and that you are authorised to make payments using the card details you have provided.
Payment processing on the Website is handled by a third-party payment processor. Online payment transactions may be subject to validation checks. If your card issuer does not authorise the transaction, you will be notified during checkout.
Payments on the Website are made in British pounds sterling (GBP).
6. Refunds
Refunds will be made to the same payment method or bank account originally used to place your booking. We endeavour to ensure that refunds are processed within 14 days from the date we receive your cancellation request.
If you booked a service and paid extra for additional services, these additional charges may not be included in your refund. Please refer to our cancellation policy for detailed information.
7. Liability
Nothing in these Terms of Sale shall limit or exclude liability for death or personal injury resulting from negligence, or for fraudulent misrepresentation. Nothing in these terms shall limit or exclude liability in any way that is not permitted by the Consumer Rights Act 2015, the Consumer Protection Act 1987, the Sale of Goods Act 1979, or any other applicable laws or regulations.
We will not be liable where damage or loss was caused by events that are not reasonably foreseeable or beyond our control.
Our services are for personal use. They are not to be used directly or indirectly in connection with any business or undertaking intended to produce a profit unless exceptionally agreed in advance with the Company. As a result, we will not be liable for any loss or damage to a business however caused in connection with our supply of Services.
8. Intellectual Property
Holiday Sleep LTD owns and controls any proprietary rights or intellectual property in the Website and the content presented on the Website.
You shall not make publicly available images of our services where the label and/or logo is visible and based on the context the images could reasonably be deemed disreputable or likely to cause harm to the Holiday Sleep LTD brand.
9. Governing Law
These Terms of Sale shall be governed by and construed in accordance with the laws of England and Wales and disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Waiver
If we elect to waive any of our rights under any section of these Terms of Sale, this will not bar us from bringing future claims; if we do not enforce our rights against you, this does not negate your contractual obligation to perform in accordance with these Terms of Sale.
11. Severability
If a provision of these terms is determined by judicial proceeding or another competent authority to be unlawful or unenforceable, the remainder of these terms shall remain in full effect.
12. Variation
We may amend these Terms at any time. We will promptly update the Website with any changes, and the revised terms will be deemed to take effect on the date they are published, which will be noted at the top of the page.
The amendments will not have any bearing on orders placed prior to the date they are published.
We may assign our rights and obligations to another company or organisation; however, this will not alter any of the agreed Terms between us. You may only transfer your rights and obligations under this contract with our prior agreement in writing.
13. Entire Agreement
These Terms of Sale, in conjunction with our Privacy Policy and our Terms of Use governing the Website, constitute the entire agreement between us.
A person who is not a party to these Terms shall have no right to enforce or receive the benefit of any of these Terms.
